Attorney Todd Kincannon former South Carolina Republican boss Tweets "trannies should be locked up"

This is a couple of days old but quite honestly I had bigger fish to fry than Todd Kincannon. Now its Kincannon's turn and the girdle is still hot. Good old boy Tod obligingly tweets his self right on in and cooks us up some old fashioned south Carolinian republican hate.... sorry about the stench.

It all began somewhere about here:

Kincannon's Linkedin profile says that he was a former executive director of the South Carolina GOP, but he fails to mention he was only in that position for three months before resigning.

Kincannon is truly small fry and hardly deserving anyone's attention especially since he told a disabled vet he wished he had come home in a body bag.

Kincannon defended this racist tweet on Huffpost live.

We can learn one thing from this. Do not allow yourself to be baited by the likes of lawyers Kincannon or Cathy Brennan. They both seek the same results, its just Kincannon admits to it. It's curious that ether are still practicing law given the American Bar Associantion's stand on transgender inclusion.

South Carolina's Bar Association policy on personal views:

Section 6.3 Personal Views of Members. Any member who, when making public utterance, permits himself to be identified as having an official connection with the Bar or one of its divisions, sections, committees, boards, task forces, or commissions shall, if the policy of the Bar on the subject matter of the utterance has been determined by the House of Delegates or Board of Governors, fairly state that policy and, if he expresses views at variance with it, clearly identify the variance as his personal views only. If there has not been, or if he has no knowledge of, any such policy determination, he shall nevertheless identify his utterance as his personal views.

Fox News article about a Colorado transgender student 'harassing' girls in the bathroom is a lie

Fox News article "Girls 'Harassed' In School Bathroom By Transgender Student Told His Rights Trump Their Privacy" remains up even though the daily Mail  took down the article and the Examiner retracted their article and offered an apology to the student for not fact checking.

The Christian Broadcasting article about a Florence High School transgender student harassing cisgender girls in the bathroom which started all of this remains up even though it has been revealed as a total lie.

The Christian Broadcasting video:

Cristan Williams posted this interview with the town’s school superintendent.

Petition drive to force a vote on San Antonio's New Lgbt inclusive Ordinance fails

The petition drive to force a referendum on San Antonio's new LGBT inclusive ordnance led by pastor Pastor Gerald Ripley of Abundant Life Church failed to collect the 61,046 signatures needed.
MySA noted that the Cornerstone  was the only mega church that participated. I was part of Soulforce's 2009 effort to reach out to pastor Haggee at Cornerstone.

Evidently we failed at Cornerstone so at risk of sounding to smug I would like to dedicate this version of "Onward Christian Soldier" to Pastors Gerald Ripley and Haggee:

Onward, Fundie soldiers, kill a queer for Christ.
Wait! They are protected — Lord that burns our rice!

Once we ran the government, threw them to the cops,
Now we cannot do a thing but fume and grind our chops!

Slog on, Fundie soldiers, peddling hate and woe —
Now the mainstream shuns us, our lives really blow!

MISSOURI LT. GOV. PETER KINDER CALLS FOR GRAND JURY IN DAISY COLEMAN CASE

Lt. Gov. Peter Kinder
Lt. Gov. Peter Kinder
Just received this via email from the office of Lt. Gov. Peter Kinder:
Lieutenant Governor Peter Kinder today released the following statement urging Missouri Attorney General Chris Koster and the Nodaway County Prosecuting Attorney Robert Rice revisit a controversial alleged rape case in Nodaway County.
“Since Sunday I have read with growing dismay the media accounts of the Daisy Coleman case in Nodaway County. I make no claim to knowledge of all the facts. Still, facts revealed in exhaustive media reports, including the 4,000-word piece in the Kansas City Star, raise all kinds of questions that it is now clear won’t be put to rest. These questions will fester and taint the reputation of our state for delivering impartial justice to all.
“I am disappointed that the Attorney General would wash his hands of the matter through a brief statement by a spokesman. The appalling facts in the public record shock the conscience and cry out that responsible authorities must take another look. I call on Attorney General Koster and Prosecutor Rice to join me in asking that the Circuit Court convene a grand jury to review all the evidence, hear all witnesses, and issue a decision as to whether charges should ensue.
“I hope that responsible officials will join me in this call for a grand jury to make the final call on whether criminal charges should or should not be filed.”
Everyone save a few media outlets have forgotten the events of this year except one.

Everyone except Anonymous

What can you do?
Courtney Cole the Executive Director at Greater Kansas City Women's Political Caucus, Executive Director at MO Senate Democratic Campaign Committee and Owner and Manager at MO-Political is coordinating a protest on Tuesday, October 22, 2013, at 10:00am they will meet at the Nodaway County Courthouse in Maryville, Missouri. Details can be found on facebook here.

Ms Cole also asks that we "put pressure on Prosecuting Attorney Robert Rice who is responsible for closing the case without it being heard. Contact his office at (660) 582-8285 and ask for the case to be reopened or for Rice to turn it over to the Attorney General's office. You may also email Rice at prosatty@embarqmail.com You may also send daisies to the courthouse at 305 N. Main, Maryville 64468. Hold Rice accountable for the decision he made that has created a true injustice."

Two young girls have been raped in the town of Maryville, Missouri. Another high school football star, the grandson of a Missouri state official, has walked free. The people of Maryville turned their backs on these victims and one family has been forced to flee the town. After they left, their house was burned to the ground. On January 8th, a 14-year-old girl named Daisy and her 13-year-old friend were both raped in Maryville. Evidence of this assault was captured on film. Daisy's unconscious body was later dumped into her family's yard, left alone for hours in freezing weather. One of Daisy's attackers was initially in police custody, where he admitted to having sex with her while she was under the influence. He claimed it was consensual. The hospital states the young girl's blood alcohol level was almost twice the legal limit and they discovered three tears inside of her body, 2-4 inches in length. This suspect rapist is Matthew Barnett, a student at the University of Central Missouri. He's the grandson of Missouri state Representative, Rex Barnett. We demand an immediate investigation into the handling by local authorities of Daisy's case. Why were the suspects initially arrested and then released? How was video and medical evidence not enough to put one of these football players inside a court room? What is the connection of these prosecutors, if any, to Rep. Rex Barnett? Most of all, We are wondering, how do the residents of Maryville sleep at night? We have heard Daisy's story far too often. We heard it from Steubenville, Halifax and Uttar Pradesh. In some cases, action meant nothing because it couldn't bring them back. Both Amanda Todd and Rehtaeh Parsons, girls not much older than Daisy, took their own lives after the adults, the police and the school system, failed to protect them. If Maryville won't defend these young girls, if the police are to cowardly or corrupt to do their jobs, if justice system has abandoned them, then someone else will have to stand for them. Mayor Jim Fall, your hands are dirty. Maryville, expect us. We Are Anonymous. We Are Legion. We do not forgive. We do not forget. Join us. Sexual Assault In Maryville: A Timeline

1 a.m. — Daisy Coleman, 14, and a 13-year-old girlfriend sneak out of the Coleman’s home after texting with Matthew Barnett, 17. They go through a basement window at the Barnett home and begin drinking out of what is referred to as the “bitch cup.” Including Barnett, present were Nick Groumoutis, Cole Forney, Jordan Zech and a minor boy.
2 a.m. – Daisy Coleman and her friend are returned to the Coleman home, the younger girl told by the boys to go in and let Daisy stay outside and “vomit.” Daisy is propped up beside the house.
5 a.m. – Daisy Coleman discovered on the front porch of the family home.  She’s wearing sweatpants and a T-shirt, her hair wet and frozen. Her shoes, purse and cell phone are later  found by a Nodaway County sheriff’s investigator in the yard. The temperature was 30 degrees.
6:05 a.m.  — Deputy Ian Myers sent to Coleman home on sexual assault complaint. He finds Daisy Coleman incoherent and discovered five plastic bottles that had contained alcohol. Myers also takes as evidence Daisy’s clothes and cell phone. Texts from Matt Barnett are found on Daisy’s phone.  Daisy is taken to St. Francis Hospital. While there, Melinda Coleman tells Myers that Daisy’s friend was also assaulted. She is taken to the hospital, too.
9 a.m. – Among other injuries, Daisy Coleman’s rape exam shows three tears, 2-4 inches in length, which is positive for rape. Her blood alcohol is .14. (.08-.10 blood alcohol level is considered legally drunk.)
7:50 a.m. – Melinda and Daisy Coleman are interviewed at the hospital by Sheriff’s Capt. David Glidden.
9:30 a.m. – The minor girl’s mother is interviewed at the hospital by Glidden. The underage boy, who admits to having sex with the girl, was taken into custody at his home and later taken to the Juvenile Detention Center in St. Joseph, Mo.
10:25 a.m. – Sheriff’s investigators take photos of vomit in the grass outside Coleman home.
11 a.m. – Barnett is interviewed by Glidden at the sheriff’s office. He admitted he knew Daisy had been drinking before he had sex with her, but that she was only “buzzed” at the time and later drank more. He said he used a condom, which he later threw out of his car window as he was taking the girls home. Daisy was crying on the ride home, Barnett said. Barnett’s cell phone is seized. Groumoutis and Forney are taken to the sheriff’s office for interviews. Zech refuses to make a statement.
1:25 p.m. – A search warrant is served at the Barnett home and evidence (bedsheet and blanket, Gatorade bottles, a bottle of Bacardi “Big Apple,” panties, boxers and red plastic cup) was taken.
2:10 p.m. — Groumoutis is interviewed by Glidden. He said his iPhone was used by Zech to video Barnett and Daisy Coleman. The video was 5-10 seconds long and he had already deleted it from his phone, Groumoutis said. The phone is seized.
January 9, 2012
11:15 a.m. — Warrant for arrest of Barnett is served while he was in custody at the Nodaway County Jail.
11:30 a.m. — Trevor Schafer, a friend of Barnett, is interviewed by Glidden. Barnett called him to ask to drive Daisy Coleman and her friend home, he said. Schafer said he drove Barnett, the girls, and the minor boy back to the Coleman’s home. He said Daisy was crying and seemed drunk. Once the girls were dropped off, the minor boy and Barnett had a conversation about how Charlie Coleman, Daisy’s older brother, would “kill them for having sex,” then talked about telling Charlie they found Daisy drunk at a party and dropped her off at home, Schafer said.
January 13, 2012
10:20 a.m. — Zech is questioned at the sheriff’s office by Glidden, at first exercising his right to remain silent. He then decides to talk and admits that he used Groumoutis’ phone to take the video of Daisy Coleman and Barnett, though he said he didn’t think they were having sex. He said Groumoutis then deleted the video. He was arrested while in custody.
February 16, 2012
12 p.m. – Zech is interviewed by Glidden, with his attorney present. He said Daisy Coleman and Barnett went into the bedroom twice and that she drank several-- five to 10 shots of vodka. He admitted to videotaping the two kissing, naked from the waist down. Zech said he didn’t notice if Daisy Coleman was crying, but that she was very drunk and could not walk.
March 13, 2012
Sexual assault charge against Barnett is dropped. Sexual exploitation charge against Zech is dropped.

Gullasmag asks Gay and Lesbians to enable transgender youth suicides

In this era of Internet the transgender community has  to confront transphobia from many angles. Christians who's unread bibles hurt, thrown at pastors urging. Red and blue politicians catering to conservative voters.

But none so vile and potentially life threatening as the TERF lead by Gullusmag who posts on "Gender Trender".

TERF, (Transgender Exclusive Radical Feminists) splintered from most other radical feminists years ago by making there primary focus the eradication of transsexualism. They used there proximity to the LGB community to promote their agenda with parlance obfuscating there true objectives while making war on the trans community.

Gullasmag's latest article removes any doubt about there hatred of transgender people.

Gullasmag posted about the original article “I told my mom that I wanted to be a girl” retitling it "The Making of a Transgender Child".

I will post Gullasmag's article in full simply because I could not say it better.

The Making of a Transgender Child

October 12, 2013

Daniel
“I knew when she was little. She was I’d say 3, 3 and a half. And like any typical parent we would read the story books and fairy tales and all kinds of stuff. And we ended up reading Cinderella, she wanted to read Cinderella, so we were reading Cinderella and at the end of the story she told me that she was gonna grow up and marry herself a handsome prince. We tried to convince her that she was gonna grow up and marry a princess and she was adamant that no, she was going to marry a prince. So at that point, yanno we’d kinda thought it was a phase and she would grow out of it. And it turns out it wasn’t a phase. So when she came to us when she was seven and said that this isn’t how she wanted to live and if she had to live this way she didn’t want to… we went looking for help. And got in touch with family services of york region, met Barbara, and one thing after another after another and here we are and we have “Danielle”.

We didn’t know for the longest time what we were gonna be faced with. We knew that there was something there. So we chose to basically ignore it for a little while to see where things would go. But she got very behavioral, withdrawn, yanno tended to not wanna come out and play, she just wanted to sit in her room. So we kept trying to talk to her and ask her like what’s going on, how are you feeling, why are you feeling this way, and most of the time it would end up with her in tears shutting down, wouldn’t talk to us. And then the one day I was cooking dinner and she came out and told me flat out- I don’t wanna live like this anymore. I want to be a girl. I am a girl. And so the choice was made to… let her make the choice. You’re either Daniel, or you’re Danielle. You make the choice.

And obviously… what her choice was.
So.”
 http://www.thestar.com/life/health_wellness/2013/10/04/i_told_my_mom_that_i_wanted_to_be_a_girl.html

...then Gullasmag begins her narrative:

Look how the hack reporter Carys Mills lazily re-frames the actual words mom says into the “typical transgender narrative”, and uses that narrative to shill for the “Sick Children” facility for “Sick Children Who Are Flaming Homos” where Daniel will be “treated” by retarding his pre-pubertal gonads followed by sterilization to correct his defect of wanting to marry a prince. WAKE UP Gays and Lesbians and so-called supporters. WAKE UP. This is happening ON YOUR WATCH.

DO something. SPEAK UP in your COMMUNITY, on websites that post this shit, to your government representatives that you VOTE for, at the BAR, at the bus stop, at your CHURCH, to your family and co-workers, to your BARBER, at the grocery store, at your LGBT CENTER, at your pride march, on your FACEBOOK, to the news agencies.

Seven year old kids ARE NOT CONSENTING TO THIS. It is THEIR PARENTS who are DOING SO. Stop them from transgendering boys who WANT TO MARRY A PRINCE. Speak up for seven year-old Daniel. SPEAK UP FOR DANIEL. This is BULLSHIT! HOMOPHOBIC BULLSHIT! This could have been YOU. And you KNOW it. So STOP THIS SHIT. Fuck some shit up. Do it FOR DANIEL.

Speak up and say “LET KIDS BE KIDS”. And “GAY KIDS ARE NOT SICK KIDS”. Including GAY KIDS who want to marry a FUCKING PRINCE.

CFA 12 video: Fallon Fox Loses to Evans-Smith in 3rd round TKO

Evans-Smith came out and stunned Fallon Fox right from the beginning with a bad ass take down. I don't think Fallon Fox was prepared for this one.

Trigger warning. If you read any of the comments on the UFC or the MMA they are full of despicable transphobic asshats belittling womankind as a whole.

One person said that Fox was a two time loser. Once for cutting her 'junk' off and the second for being beaten by a girl. Yeah. That Misogynistic transphobic moron got a chance to voice his hate of womankind at the expense of transsexualism. Nice.

Stay strong Fallon Fox. Put that key back in the ignition and I'll meet you on the highway. Don't think we'll meet any of the fat asses along the run who posted those comments. There faces are filled with potato chips, bellies with beer and hearts with fear.

Watch University of Northern Iowa(UNI) senior Steven Sanchez get Crowned Homecoming Queen

UNI senior Steven Sanchez never expected to be accepted and welcomed at any school. Because he grew up outside the gender binary he quit high school after being bullied by his peers.

“I’m not 100 percent man or woman,” Sanchez told the student newspaper on learning of his nomination to the court explaining “I don’t fit into either box.”

“I was so excited and my friend was like, ‘what is going on?’” said the senior communications major. “It was hard to contain my excitement for a week, before we were allowed to announce it.”

Sanchez is the first biological male nominated for Homecoming queen. He identifies as a male transgender student or gender queer, meaning he embraces the gender spectrum.

The hunt for Kuwaiti Transgender people moves to the border

In 2007 a law was passed in Kuwait promoting the eradication of indigenous transgender people. Societal ambivalence was replaced with terror enhanced by local media as police began hunting down transgender people for fun, like they would hunt animals, for the sport of it.

Now the Kuwait Ministry of Health has proposed tightening genetic tests for immigrant workers in order to prevent transgender migrants from entering the GCC job market.

One unverified report is that 121,000 people have left Kuwait in the past two days leaving some wondering on the Kuwait Upto date facebook page if the proposed crack down on transsexuals and LGB people have had anything to do with this mass exodus.

Tawfiq Khojah, director-general of the Executive Office at the GCC Health Council, said, "The health checklist for migrant workers now contains a mandatory examination to determine gender."
These constrictions are necessary to preserve Islamic principles, he added. The proposal will be made in a meeting for the Central Committee for foreign workers' at the Health Council to be held on Nov. 11, Khojah told Arab News.

"Undergoing the test will become mandatory for an estimated 289 health centers across the GCC if the Health Council approves the proposal of tighter controls on gender tests for migrant workers. More than 2 million expatriate workers underwent the new gender tests in 2012," he said.

Youssef Mendkar, director of the Public Health Department at the Kuwait Ministry of Health, confirmed that the proposal aims to prevent transgender migrants from working in GCC countries. The tests determine the gender at birth.

Gender is also determined through the worker's medical history. According to local media, sex conversion operations are considered normal in some countries which supply manpower to GCC countries.
He said that statistics from the Ministry of Social Affairs and Interior show that some foreign workers had a different gender recorded on their identity documents.

Amnesty International issued a statement that "Kuwait must reject proposed homophobic ‘medical tests’ on migrant workers".

Under the new proposal, put forward on 7 October by Dr Yousuf Mendkar, the Director of Public Health at the Kuwaiti Ministry of Health, anyone deemed “homosexual”, transgender and/or cross-dresser after a “medical test” will automatically be prevented from entering the country.
The proposal will be debated at a meeting of the Central Committee for Expatriate Labor Forces Program of the Gulf Cooperation Council (GCC) in Oman on 11 November.
Migrant workers from certain countries, mostly in South and South East Asia, are required to undergo medical assessments when they apply for permits to work in Kuwait and other GCC countries. The proposal, if passed, would add the new “medical test” to these assessments.
“Authorities in Kuwait and other GCC states must reject any proposals to introduce these discriminatory ‘medical tests’ to ‘assess’ the sexual orientation or gender identity of people entering the country,” said Philip Luther.
“It is an affront to the fundamental human right to privacy and underscores the continuing persecution of individuals based on their sexual orientation or gender identity.”

Watch Larry King's former teacher Shirley Brown on "Valentine Road" say she 'relates' to transphobia

Oxnard California junior high school teacher Shirley Brown said she understands how the boy who murdered Larry king felt after being given a Valentine card by King. “I relate to Brandon because I could see my own self being in that very same position.

In fact, she thinks Larry's murder was comical, perhaps poetic justice explaining how she would have reacted:. “I don’t know if I would have taken a gun, but a good swift kick in the butt might work really well,’ she added, laughing.

Completely irate about the LGBT pride parade that followed in Oxnard she asks "Who would do such a thing? Who would do that?" She needs to ask that question to the man in the center of his apostles in the picture on her wall. His answer has been there for the taking all along.

Is this person still teaching? Is she still enabling transphobia and homophobia in public schools?

Romy Maynard charged with the murder of north London transgender woman Chrissie Azzopardi

Source Huffington Post: A man stabbed a transgender woman to death in her bedroom before leaving her decomposing body undiscovered for more than a month, a court has heard. Romy Maynard, 28, is on trial accused of killing 22-year-old Chrissie Azzopardi at her home in Crescent Way, north London, in April last year.

Azzopardi, who was due to undergo gender surgery later that year, was found lying on her bed with fatal stab wounds after neighbours noticed a bad smell coming from her flat and raised the alarm in June 2012, the Old Bailey heard. Opening the prosecution's case, Mark Heywood QC said the victim had been stabbed in the chest, pushed down and then stabbed again with force which had pierced her heart.

"The killing was swift and brutal," the barrister said. "It is likely she fought back but was very quickly overwhelmed. The killer then left her while she lay on the bed, dead or dying. In all probability she knew her killer and she allowed him there. He covered her face with one of the pillows from the bed, either to finish his work or perhaps to avoid her stare in death. The crown says this killing is the work of the defendant. He says he is not the killer and so that it must be someone else."

Romy Maynard lived just down the road from Chrissie Azzopardi with his wife and children. It is said that there were multiple phone conversations prior to her murder.

"Valentine Road" the story of Larry King, murdered for his gender expression premieres on HBO Tonight

Just a few miles and years away from where Larry King was murdered a transgender girl was just voted Prom Queen and then bullied into suicidal thoughts by some of her classmates that very same night.

Larry King's former teacher says she would have reacted violently if she had been Brandon McInerney position so the conversation must continue...

The following is a partial transcript from the NPR interview of the director of "Valentine Road":

CUNNINGHAM (Director): "And I just want to clarify that from what I found out about Larry, it was really a gender expression and gender identity kind of exploration that he was going through. Not so much his sexuality, which I didn't know until really much later when I started working with the center - the Gay and Lesbian Center in Los Angeles."

HEADLEE: "He began wearing high-heeled boots and makeup to school..."

    CUNNINGHAM: "Right."

HEADLEE: "...Not long before this whole incident."

CUNNINGHAM: "Exactly. The two weeks before his death, he was wearing the uniform still but wearing heels and wearing makeup, doing his hair in a feminine manner with a bow, sometimes earrings - you know, dangly, chandelier earrings, which were actually pretty cute. So I felt that that was even more shocking to me, that this was something that really was dealing with femininity and what was so wrong with being feminine."

'Valentine Road' : HBO  9 p.m. Monday 10/7/2013 Rating: TV-14 (may be unsuitable for children under the age of 14)

    Transcript courtesy of NPR

    CELESTE HEADLEE, HOST:

I'm Celeste Headlee and this is TELL ME MORE from NPR News. Michel Martin is away. We cover a number of issues related to sexuality on this program, and the past year has shown progress for the LGBT movement. This month, for example, a transgender teenager was named homecoming queen in Huntington Beach, California. But just five years ago, a couple of hours up the road, a teen died for openly exploring his sexual identity. Here's how Ellen DeGeneres addressed his death on her show.

(SOUNDBITE OF TV SHOW, "THE ELLEN DEGENERES SHOW")

ELLEN DEGENERES: On February 12th, an openly gay 15-year-old boy named Larry, who was an eighth grader in Oxnard, California, was murdered by a fellow eighth grader named Brandon. Larry was killed because he was gay. Days before he was murdered, Larry asked his killer to be his Valentine. I don't want to be political, but this is personal to me. A boy has been killed and a number of lives have been ruined, and somewhere along the line the killer, Brandon, got the message that it's so threatening and so awful and so horrific that Larry would want to be his Valentine, that killing Larry seemed to be the right thing to do.

HEADLEE: A new film, the HBO documentary "Valentine Road" now delves into the life and death of Larry King. His killer, Brandon McInerney, is currently serving a 21-year sentence. The film's director, Marta Cunningham, joins me now to tell us more about it. Welcome to the program, Marta.

MARTA CUNNINGHAM: Thank you so much for having me, Celeste.

HEADLEE: This was a four-year project for you, right?

CUNNINGHAM: Yes, 2008 I started filming, in the fall of 2008 - and it happened February 12, 2008.

HEADLEE: That's a long time to be focused on a very tragic story. What kept you in this film - what kept you coming back to this story?

CUNNINGHAM: I think the children in the film. The young adults, now, I mean, some of them are off in college, but at the time when I meet these kids, they were 13 years old. And some of them had witnessed this horrible crime in the classroom and really had no one to talk to. I mean, it was unbelievable. They had one day of therapy, and it was in a library and it was kind of like this - so how are you doing?

And most teenagers kind of grunt and they grunted and they were going - next. And so I was the first adult that they had met that really cared about Larry, Brandon, the situation they were in. Everyone was trying to sweep it under the rug that they knew. So they were really unloading. There was a lot of unloading and grief and kind of coming to terms with what had happened.

HEADLEE: Well, let's talk about exactly what happened. These two kids. Larry was the young man who was killed, Brandon was the young man who killed him. What led up to the murder on that day?

CUNNINGHAM: Well, from what we know, and what we were told by Larry's friends, is that he walked up to Brandon on the basketball court and asked him to be his Valentine on a dare, and two days later, he was dead. You know, he was shot twice in the back of the head by Brandon on the 12th of February and then died on Valentine's Day.

HEADLEE: Brandon had gotten the gun from where?

CUNNINGHAM: His grandfather's house. He was staying at his grandfather's house and he got it out of the closet, which was unlocked at the time.

HEADLEE: Here's a clip of the prosecuting attorney, Maeve Fox, talking about this murder in your documentary.

    (SOUNDBITE OF DOCUMENTARY, "VALENTINE ROAD")

MAEVE FOX: Because of the vicious nature of the crime, this is not a crime that the juvenile system is capable of handling. What do you do with someone like this, who is so dangerous that they plot out the execution of a classmate in front of a whole classroom full of people?

HEADLEE: And yet, that's not necessarily the picture of Brandon McInerney that comes - that I came away with at least from your documentary film - this idea of this extraordinarily dangerous threat to society. What did you feel like you learned about Brandon?

CUNNINGHAM: Well, I think it's really interesting. It depends on who watches it because some people still do feel that he is a threat to society, and others understand that he was a boy, and therefore, should be treated as such. I think that it lies somewhere in the middle. I really don't know. I'm not a psychologist, but I can tell you that I talked to Maeve yesterday, and one of the things that she repeated to me was if he's doing this at 14, then who's he going to be at 24 or 34 and 44?

And I just think it was a big enough subject to tackle. And we may be asking more questions than answering them in the film, but I really wanted to bring it to an audience to start looking at some of these big issues that we're just not talking about, which is trying children as adults. Is that right? Is it fair? Is that something we want to continue doing? It's not just in California. New York does this, New Jersey, and more are starting to. So is this something that we're comfortable with - the trend of trying children as adults? I want that conversation to be had.

HEADLEE: I should be clear that you're film, in no way shape or form, tries to make excuses for the murder - the really cold-blooded murder of another teenager, but you do start to see a few similarities between these two boys, both Larry and Brandon. Can you tell me about maybe some of the ways in which their life experiences intersected?

CUNNINGHAM: I think that's really what kept me going. You asked me before, and I think it was the similarities between these boys that almost attracted them to each other. They both had extremely difficult childhoods. And when I looked at that and spoke to the people that knew Larry and Brandon, like Brandon's family, I couldn't help but feel a tremendous amount of empathy for this child. And I always felt a tremendous amount of empathy for Larry because of how misunderstood he was.

And even the kids later on, how much regret they had for any type of teasing that they did. And really, they were the ones who were asking for forgiveness throughout the film. They were the ones who had the regret, and some of the adults really didn't feel that they needed to be forgiven for the way they treated him. So I thought that was also very interesting. But the similarities really came back to difficult childhoods, being misunderstood and not being seen. You know, some of these kids are really invisible, and we have to make sure that that doesn't happen. I mean, that's our responsibility, I think, as adults.

HEADLEE: If you're just joining us, I'm speaking to director Marta Cunningham about her HBO documentary "Valentine Road." Since you talked about the adults, one of the most compelling moments there was when we were seeing some of the jurors there - and this was a shocking moment. You sit down with some of the ladies who were on the jury of this case, and they're drinking wine and they're eating some cheese, and it's just really a telling moment. Let's take a listen.

    (SOUNDBITE OF DOCUMENTARY, "VALENTINE ROAD")

UNIDENTIFIED JUROR: I do not think it was first-degree murder. However, it was premeditated. He had a plan to resolve this terrible problem because nobody was taking care of this problem.

CUNNINGHAM: By murder or just to maim him?

JUROR: We don't know. And then he's having second thoughts about doing it. But then, the green light, when he says, hey, Larry, I hear you're changing your name to Latisha. To him, that's a green light - pulls out the gun and shoots him.

    CUNNINGHAM: Yeah.

JUROR: He was solving a problem.

HEADLEE: Just a stunning view of the situation. The problem of this young boy, Larry, who was trying to deal with his sexuality. Tell me a little bit more about the adults and their reaction because, as I understand it from your film, Larry's teacher was one of the few people that tried to address this, and she was eventually fired.

CUNNINGHAM: That's true. And I just want to clarify that from what I found out about Larry, it was really a gender expression and gender identity kind of exploration that he was going through. Not so much his sexuality, which I didn't know until really much later when I started working with the center - the Gay and Lesbian Center in Los Angeles.

HEADLEE: He began wearing high-heeled boots and makeup to school...

    CUNNINGHAM: Right.

HEADLEE: ...Not long before this whole incident.

CUNNINGHAM: Exactly. The two weeks before his death, he was wearing the uniform still but wearing heels and wearing makeup, doing his hair in a feminine manner with a bow, sometimes earrings - you know, dangly, chandelier earrings, which were actually pretty cute. So I felt that that was even more shocking to me, that this was something that really was dealing with femininity and what was so wrong with being feminine.

But getting back to your question about adults - Dawn Boldrin was the teacher that was let go. And what she was told was there was no more room for her because she wanted to take some time off. Obviously, after witnessing something like that and being in a classroom where one of your students kills another student, she wanted to take time off. And by the time she was ready to come back, they said there was no room for her. So it is - it's shocking that the one person who kind of said, you know what, I get you and I understand you, and I think it's perfectly fine what you're doing. And here's a prom dress, not to wear at school, but to wear at home. And I think that was amazing that she was able to see Larry and didn't treat him any differently.

HEADLEE: And she's now working at Starbucks.

CUNNINGHAM: She was working at Starbucks, and now she's gotten another job. She's a librarian now, so she's doing better.

HEADLEE: But it did make me question what has happened to the city. How has Oxnard recovered from this? Or has the city, the community recovered?

CUNNINGHAM: Can you ever really recover from something like this? I think that is a great question. I mean, when it comes to the school itself - Aaliyah (ph), one of the students, wanted to plant a tree in Larry's memory. And they planted the tree that she got from a nursery, which was donated by a nursery, and then raised money for that to be planted. But there is no plaque. There's no memory of Larry. It's not discussed at school to this day still.

HEADLEE: So you went into making this film and you probably already had some strong opinions about it, right? That's fair to say?

CUNNINGHAM: I think it's fair to say that my empathy really was just with Larry when I started this endeavor.

HEADLEE: And having finished the film?

CUNNINGHAM: I feel for both of them deeply. And now that I know their families - I mean, you know, Brandon is a self-avowed white supremacist from what his mother says. But I have to say that being an African-American woman, even with that, I look at the parenting. I look at his environment. I look at the people that he felt were reaching out and helping him. However twisted it may look to us, that was his family. And so, you know, we have to look at the environments that these people are coming from who commit these types of crimes. And we have to understand them, otherwise we're not going to stop the cycle of violence. We just - it won't end.

HEADLEE: Do you think that we are on the path at least to begin dealing with these things better. There's been so much attention paid to bullying cases around the country, especially bullying of gay and bisexual and transgender kids. Are we improving?

CUNNINGHAM: Well, I feel like - Mariska Hargitay has an incredible foundation called the Joyful Heart Foundation, and it talks about No More, which is their new campaign of stopping sexual abuse and domestic violence. And when you look at where these children are growing up in - when you look at Brandon's identity and you look at what he was surrounded by, it was domestic violence. And, you know, who knows what Larry went through before he was adopted at 2-years-old. Who knows what insane...

HEADLEE: By abusive parents, I should say.

CUNNINGHAM: Well, you know, even before he was adopted at 2-years-old - so really, we're not sure. We don't know. But we do know that it was bad enough that he was living in a homeless shelter for abused and neglected children when he was killed. So when you look at that and you see the amount of children who are suffering every day and are invisible and we really aren't taking care of them in a proper way, it's hard for me to say. Is it getting better? I hope so.

The statistics show that more and more kids are coming out earlier. So my goal with this film is to use it as an educational tool for administration, for teachers, so that they are capable and, you know, managing these types of differences. I mean, if kids are coming out younger and they're expressing themselves younger and they're prom queens in Huntington Beach, you know, we need to make sure we are having faculty that understand them.

HEADLEE: Well, it's a really stunning and sobering film. Marta Cunningham is the director of "Valentine Road." The documentary debuts next week on Monday, October 7 on HBO. Marta was kind enough to join us from NPR West in California. Marta, thank you so much.

    CUNNINGHAM: Thank you.

BC to stop requiring surgery to change gender on birth certificates

British Columbia is changing their archaic law forcing surgical modifications and sterilization prior to changing ones birth certificate.

And we can thank fifth grader Harriette Camille Cunningham and her family for their efforts in making this happen.

It's been a difficult road full of hardships for ten year old Harriette, but thanks to her family she has persevered.
The The Globe and Mail reported last month that by law, the Grade 5 pupil in the small community of Comox, on Vancouver Island, cannot change her birth certificate until she is old enough to have sex-reassignment surgery. Her birth certificate identifies her as Declan Forrest Cunningham, but her family has filed the paperwork to change her legal name to Harriette Camille Cunningham.

In a letter to her MLA, Don McRae, Harriette has asked for help to change her gender identity on paper without waiting for an operation that she may or may not choose to have years from now, “because in my opinion it really shouldn’t matter.”

That was then, this now! From the Times Colonist article dated October 5th:

A policy change underway at the Ministry of Health will remove one barrier to official recognition of gender identity for transgender people in British Columbia, the Times Colonist has learned.

Sex reassignment surgery will no longer be required before the sex designation associated with a person’s B.C. Services Card can be changed, according to the ministry.

The new policy should take effect by the end of the year, a spokesman said, but the ministry could not specify a date. Health Minister Terry Lake was not available for an interview.

B.C. Services Cards began replacing CareCards in February, and the planned change arose during the discussions surrounding that transition, according to the spokesman.

The Denver Wrangler threatens a drag queen with a lawsuit after denying him entrance

The Denver Wrangler has threatened Vito John Marzano with a lawsuit should he not remove all copies of the video of there staff harassing him on public property (the sidewalk) after they denied him entrance to the bar.  The video makes it very clear the Wrangler staff  bared him because of his gender expression telling him his feet were to big for him to be transgender.. It is unclear if the Denver Wrangler will likewise threaten  media sources but it would be safe to assume they will, given their history of intimidatory behaviour.

This is just the last of many attempts by the Denver Wrangler to coerce Marzano into removing all evidence of the occurrences on that August night.

The Denver Wrangler has also tried to intimidate myself and Cristan Williams who cross posted the original planetransgender article on the TransAdvocate. They have tried unsuccessfully to have blogger shut down planetransgender but they did succeed in getting facebook to censor the original article. Facebook sent me a message that the original article contained 'contaminated' links. I have published and posted most of the 2000 odd planetransgender articles on facebook, and that one, just that one post has a infected link? Not according to Norton safe site.

If the Denver Wrangler didn't discriminate against Vito John Marzano why are they so focused on removing the video evidence prior to the DORA hearing. If the Denver Wrangler is blameless as they claim, why are the so intent scouring the Internet clean of all evidence of that incident prior to the Civil rights hearing?

Wouldn't it be to there benefit if they were publicly exonerated by Colorado Civil Rights Division? Or is it that they know they are in the wrong and are attempting to get rid of the evidence?

The letter sent by a lawyer retained by the Denver Wrangler to Vito John Marzano:

"This is a clear intimidation tactic. The lawyer and I both know that I have not said anything which has not been backed up with screen shots or video. About the video, I encourage everyone to mute the sound (as to not get distracted) and look closely at the video. You will see that I am standing in front of the metal barricade, which ends right where the sidewalk begins. The video was filmed on a public sidewalk. Furthermore, my phone was up the entire time. It was quite obvious I was filming. Being as we were on a public sidewalk holding my phone up and saying things like "I cannot wait to post this on the internet" I can safely conclude there was no presumption of privacy. Moving on, if the Wrangler is so comfortable in their position, why are they trying to destroy the evidence?
There is a simple answer to all this- change your ID policy. Stop the discrimination. Treat all of your patrons equally and with dignity. Once that happens, I will gladly dismantle the website, video, and boycott. Until then, I have not done anything illegal and this will continue.

The video of the Wrangler staff denying Marzano access to public accommodations:

Source Denver post.com: Pete Meersman, president and CEO of the Colorado Restaurant Association, said he understands the liquor-license side of the law better than the discrimination laws but sees the conflict that businesses face.
"This was a new situation that I had not heard of before," Meersman said. "The ultimate dilemma is doing one thing to stay in compliance with the law that gets you out of compliance with another

    Vito Marzano's driver's license ( | )
    law."
Management at the Wrangler could not be reached for comment, but a video of the altercation posted by Marzano to YouTube — which has since been taken down — outlines the bar staff's reasoning: Gender identity must match a person's ID gender.
"The problem here is the application of a blanket rule that discriminates against a particular class of people based on their gender nonconformity," said Mari Newman, a Denver-based civil-rights attorney. "While I acknowledge the bar's legitimate interest in not running afoul of liquor licensing, this, by its term, is not a legal way to accomplish that goal."
Checking IDs is not required by law but is the only way bars and restaurants have to verify a customer's age. Subsequently, there is no standardized method for comparing a person's ID with their physical appearance — those policies are determined and set by the business owners.
